Proposed Cannabis Act Raises Questions About Consumption Thresholds When Operating Motor Vehicles

Currently, it is not illegal to operate a motor vehicle after you have consumed alcohol. It it is ONLY A CRIME if your blood alcohol content (BAC) exceeds the legal threshold of 0.08%. (some provinces have different administrative BAC warnings)
Similarly, with the legalization of marijuana, it will not be illegal to drive if you have consumed marijuana. However, at what point will the legal threshold be set that determines what consumption levels exceed the prescribed level permissible by law? Will there even be a level set? Can it be measured? How will they screen for impairment?
It will be interesting to see how the new legislation will “fit” within the remainder of the Criminal Code of Canada.
